2. Scope

These Terms govern the use of the websites and services operated by the NaturaSports platform, namely:

  • naturasports.pt;
  • the branded websites that the platform operates on behalf of partner organisations, such as rotasdosdiabos.pt (§3).

By using any of these websites, you accept these Terms. Registrations for events are also subject to the Event Registration Terms and, where applicable, to the rules and specific conditions of each event. The processing of personal data is described in the Privacy Policy and the Cookie Policy.

3. Branded websites of partner organisations

Some websites belong to partner organisations and are operated by the platform under contract. The rotasdosdiabos.pt website and the Rotas dos Diabos brand are the property of the Municipality of Vinhais, which owns the institutional content published there.

The technical operation of these websites, user accounts, registrations and payments are handled by Vertente Magenta through the NaturaSports platform. Therefore:

  • an account created on a branded website is a NaturaSports account and gives access to all of the platform’s websites;
  • registrations and payments made on a branded website are governed by these Terms and by the Event Registration Terms;
  • any questions about your account, registrations, payments or personal data should be addressed to the platform (contact details in §1), not to the organisation that owns the website.

4. User account

4.1. The websites may be browsed freely. An account is required for registrations, volunteering, favourites, reviews and the partner area.

4.2. You may register with an email address and password or with a Google, Facebook or Apple account. In the latter case, that provider sends us your name and email address, in accordance with its own terms.

4.3. Age. You must be at least 13 years old to hold an account. Between the ages of 13 and 17, registration for activities requires confirmation by a parent or legal guardian. Children under 13 may only take part if registered by a parent or legal guardian from that person’s own account.

4.4. You undertake to provide true and up-to-date information, to keep your password confidential and to notify us of any unauthorised use of your account. You are responsible for all activity carried out using your credentials.

4.5. Each account corresponds to one person. Management accounts (for the platform’s team and for partner organisations) are kept separate from user accounts.

4.6. You may delete your account at any time in the My data area. Your data will be anonymised, except for data we are required by law to retain (for example, invoices, for the statutory tax retention period).

4.7. We may suspend or close accounts that breach these Terms, after prior notice, except in serious or urgent cases.

5. Third-party content: events, volunteering and partners

5.1. The platform publishes information provided by event organisers, organisations promoting volunteering activities and partners (accommodation, restaurants, guides, outdoor activity and tour operators, institutional bodies).

5.2. This information — dates, programmes, prices, places available, requirements, rules, cancellation conditions, descriptions, opening hours and contact details — is the responsibility of whoever publishes it: the parties concerned themselves, organisations authorised by them, or organisations publishing under a contract with Vertente Magenta.

5.3. The organisation and running of events and volunteering activities are the responsibility of the relevant organiser, identified on the page. Partners’ services are provided by the partner itself, under the conditions it sets.

5.4. The platform reviews the content it publishes and removes content that is unlawful or manifestly incorrect as soon as it becomes aware of it, but does not guarantee the accuracy or currency of third-party information. If you find an error, please let us know using the contact details in §1.

6. Registrations and payments

6.1. Registrations for events are governed by the Event Registration Terms and by the conditions of each event.

6.2. For paid events, the platform collects payment on behalf of the organiser. Payments are processed by Ifthenpay (Multibanco, MB WAY or card) and invoices are issued through Moloni.

6.3. Refunds follow the organiser’s conditions as stated on the event page. If the event is cancelled by the organiser, the amount paid will be refunded in full.

7. Routes and outdoor activities

7.1. Routes, GPX tracks, elevation profiles, times, difficulty ratings, points of interest and maps are for guidance only. Terrain, waymarking, river levels and access may change without notice.

7.2. Outdoor activities involve risks. Each user is responsible for assessing their own physical fitness, equipment, the weather and ground conditions, for respecting waymarking, private property and the rules of protected areas, and for not relying solely on electronic devices for navigation.

7.3. In an emergency, call 112.

7.4. The platform is not liable for any damage arising from routes or activities undertaken on the user’s own initiative. Responsibility for organised events lies with the relevant organiser (§5.3).

8. Content published by users

8.1. By publishing reviews, comments or photographs, you warrant that you are entitled to do so and that the content is truthful and respectful. You grant the platform a free, non-exclusive licence to display it on the platform’s websites for as long as it remains published.

8.2. Reviews are moderated, and an automated check may be applied before human review. We may decline to publish, or remove, content that is offensive, false or promotional, that identifies third parties without their authorisation or that breaks the law.

9. Intellectual property

9.1. The NaturaSports® brand and the platform’s software and design belong to Vertente Magenta. The Rotas dos Diabos brand and the institutional content of the corresponding website belong to the Municipality of Vinhais. Content provided by partners and organisers belongs to their respective owners.

9.2. You may download GPX tracks and leaflets for personal, non-commercial use. Reproduction, redistribution or commercial use of content, and the systematic extraction of data (scraping), are not permitted without written authorisation.

10. Personal data and infrastructure

10.1. Controller. Vertente Magenta is the controller of the data relating to accounts, registrations and payments on all of the platform’s websites. Contact: rgpd@naturasports.pt. Further details are set out in the Privacy Policy.

10.2. We do not sell data. We do not sell or transfer your data to third parties for their own purposes. We only share it with those who need it to provide the service you have requested:

  • with the organiser of the event you register for, in order to manage your registration;
  • with the partner to whom you send a contact or quotation request;
  • with the suppliers that provide technical services on our behalf (§10.3), who are contractually bound to process the data only in accordance with our instructions.

10.3. Infrastructure in the European Union. The platform runs on dedicated infrastructure, managed directly by NaturaSports and hosted in data centres in the European Union, under European data protection law. Our main suppliers are:

10.4. Services outside the EU chosen by the user. Data only leaves the EU when the user chooses an external service: signing in with Google, Facebook or Apple and playing YouTube or Vimeo videos embedded in our pages. In those cases, the terms of those providers apply. Some background maps are served by external providers, which receive only the IP address needed to display the images.

10.5. You may exercise your rights of access, rectification, erasure, portability, restriction of processing and objection in the My data area or by writing to rgpd@naturasports.pt, and you may lodge a complaint with the Portuguese Data Protection Authority, the Comissão Nacional de Proteção de Dados – CNPD (www.cnpd.pt).

11. Availability and liability

11.1. We aim to keep the websites available at all times, but interruptions may occur due to maintenance, technical faults or force majeure.

11.2. The platform is not liable for: temporary interruptions of the service; damage caused by improper use of the websites; third-party content (§5); activities undertaken on the user’s own initiative (§7.4). Nothing in these Terms excludes or limits the rights that consumers have by law.

12. Prohibited uses

You may not: use the websites for unlawful purposes; create false accounts or accounts in the name of others without authorisation; attempt to access unauthorised areas or data; interfere with the operation of the platform; collect data by automated means; publish unlawful, offensive or misleading content.

13. Changes

We may update these Terms. Each version is dated at the top. Significant changes are notified to registered users 30 days in advance; if you do not agree, you may delete your account before the changes take effect.

14. Governing law and dispute resolution

14.1. These Terms are governed by Portuguese law.

14.2. In the event of a consumer dispute, consumers may refer the matter to an alternative dispute resolution body: CNIACC — Centro Nacional de Informação e Arbitragem de Conflitos de Consumo (National Centre for Consumer Dispute Information and Arbitration, www.cniacc.pt), or the consumer arbitration centre for the area where they live. Further information is available on the Portuguese Consumer Portal, Portal do Consumidor (www.consumidor.gov.pt).
